For decades, the Department and courts have applied an economic reality test to determine whether an employee is an employee or an independent contractor under the FLSA. The last question is whether the employee is economically dependent on the employer for his work or does business for himself. To answer this latest economic dependency study, the courts and department have conducted a totality of circumstances analysis in the past, taking multiple factors into account to determine whether an employee is an employee or an independent contractor under the FLSA. Many circuit courts apply this factor in view of whether the employee uses management skills to influence the employee’s likelihood of profit or loss. For example, the third circuit describes the factor as the possibility of profit or loss, depending on the management ability. After further investigation, the Department believes that IC Rule 2021 is not fully consistent with the text and purpose of the FLSA as interpreted by the courts.
